Avery was first born in Manitowoc County, Wisconsin, on July 9, 1962. His parents are Dolores and Allan Avery, and he was born into a family of four kids.

Shortly after the assault, Avery was 40 miles from the scene of the crime, and he had 16 eyewitnesses to support his alibi. He was found guilty and given a term of 32 years in jail for the events that occurred during his year of deafness.
After serving 18 years and maintaining his innocence throughout, Avery was found not to be the attacker but Gregory Allen thanks to DNA testing.
